Main Biography

Eugene P. Souther has practiced law since 1959.  After serving as a litigation associate at Cravath, Swaine & Moore, Gene joined Seward & Kissel as a partner on April 1, 1968.  Gene served for a number of years as head of the Litigation Group and Chairman of Seward & Kissel.  After 34 years as a partner, Gene became Senior Counsel to the Firm on April 1, 2002.  Gene's substantial litigation experience includes trials in federal and state courts in New York and other states, significant appellate practice, proceedings before the SEC, CFTC, NASD, NYSE, the EEOC and state and local human rights administrative agencies, as well as domestic and international arbitration proceedings and proceedings abroad under the Hague Convention.  Gene's practice in federal and state courts covers a broad spectrum, including private securities litigation, class and derivative actions, private and public federal and state investigations and proceedings, and litigation involving employment discrimination, banking, bankruptcy, contracts, construction and partnership disputes.

Gene is a Fellow of the American College of Trial Lawyers and served through the years on the New York Downstate Committee of the College.

From 1988 to 1990, Gene was President of the New York County Lawyers' Association.  He served the Association in a number of other capacities, including Vice President, Member of the Board of Directors and Chair of the Finance, Judiciary, Nominating and Investment Committees.

Gene served as a member of the Departmental Disciplinary Committee of the Appellate Division, First Department, from 1980 to 1987 serving as a Panel Member, Panel Chairman and a Member of the Policy Committee.  He served again from 2002 to 2008 as a Panel Chairman.  After an interim period of service as a Referee to hear and report on disciplinary matters on appointment by that Court, Gene returned to the Committee as a Panel Chairman.

Gene served for many years in the House of Delegates of the New York State Bar Association and as a member of that Association's Nominating Committee.  He has also served as a Delegate to the House of Delegates of the American Bar Association and as Vice Chairman of the International Bar Association Section on Business Law Procedures for Settling Disputes.

Gene has been appointed a Special Master by the United States District Court for the Southern District of New York to hear and report on disputes.  He also was appointed an Arbitrator by the President of the Association of the Bar of the City of New York to hear and decide a dispute between an attorney and his firm as well as being selected by litigants to mediate disputes.

Gene was an artillery officer in the United States Army from 1953 to 1955 when his assignments included serving as a Battery Commander and Battalion Staff Officer.

Gene’s pro bono activities include serving for a number of years as Village Justice for the Villages of Bellerose and Muttontown in Nassau County, serving as a Member of the Board of Zoning Appeals of the Village of Lattingtown and since 2013 as Village Justice of that village.

Gene graduated from Fordham College in 1953 and from Fordham Law School in 1959.  He has been a member of the Board of Directors of the Fordham Law Alumni Association since 1959.  He has been a member of the Board of Directors of the Fordham Law Alumni Association since 1959.  He also served for many years as a Parish Trustee of St. Dominic’s Church in Oyster Bay, New York, and as a member of the Parish Finance Committee.

In addition, he served as a member of the Board of Trustees of St. Francis Hospital, The Heart Center from 1992 to 2013.  During his tenure he served on a number of committees, including Finance, Long Range Planning, Performance Improvement, Human Resources, Mission and Ministry and Compliance and Audit, which he also chaired.  He was Chairman of the Board from 2004 to 2007.  From 2007 to 2013 he also served as a member of the Board of Trustees of Mercy Medical Center and of a number of its Board Committees.  From 2013 to date, he has served as a member of the Compliance and Audit Committee of Catholic Health Services of Long Island.
