Commercial Litigation

Our litigators represent some of the largest financial institutions and financial services companies in the world in commercial disputes, and in their role as indenture trustees in litigations and bankruptcies arising from defaults under securitizations and other securities issuances.

Both domestic and international banks call on our Firm for assistance in disputes arising under structured finance agreements and swap agreements, and in enforcing loan agreements, guarantees and security arrangements.  We represent lenders and other secured parties in proceedings to foreclose on ships and aircraft, major commercial properties, such as office buildings, hotels and shopping malls, and we are involved in a variety of other real estate litigations.

We have counseled numerous NYSE and NASDAQ listed companies, privately held companies, investment management companies, investment funds, institutional investors, individuals and others in all manner of business disputes, including disputes over acquisition and distribution agreements, interference with economic relationships and misrepresentations in connection with the sale of businesses, as well as many other types of corporate and commercial conflicts, including contract claims, business torts, fraud, shareholder disputes, enforcement actions and foreclosure proceedings, trade and derivative claims, regulatory disputes, professional malpractice claims, bid rigging and price fixing actions, and a wide variety of other commercial disputes.

In connection with these litigations and arbitrations, we routinely enforce judgments and secure recovery for our clients.  We also regularly counsel our commercial clients in strategies to avoid litigation.
