Seward & Kissel Represents Kevin Kulak in Summary Judgment Victory Against Movado PT Technologies Founders
Seward and Kissel represented Kevin Kulak in obtaining summary judgement against Movado PT Technologies Founders. The original complaint alleged that Movado’s founders, Itshak “Itzik” On and Keren-Or On, fraudulently induced Kulak to invest in Movado, a technology company that had purportedly developed a mobile phone application that would analyze and treat a user’s musculoskeletal conditions, based on misleading representations about the company’s technology, customers, and fundraising progress.
In a recent ruling, the Chancery Court granted Kulak affirmative summary judgment on his fraudulent inducement claim and, on October 16, 2026, entered final judgment on that claim under Court of Chancery Rule 54(b). In addition to representing a rare affirmative win at the summary judgment stage, the Court awarded Kulak certain fees and costs as a result of Mr. and Ms. On’s continuous bad-faith litigation conduct, which involved filing numerous frivolous motions over the course of the lawsuit, as well as attacking both Kulak’s counsel and the court itself.
