Employment
Overview
Seward & Kissel’s Employment practice represents companies across the full spectrum of employment law matters.
We combine deep experience with practical judgment to help clients develop constructive and beneficial relationships with their clients and employees while mitigating risk, protecting their business interests and, if necessary, defending or resolving disputes. We are known for handling complex, sensitive employment matters with discretion and a focus on achieving durable outcomes.
Our lawyers have decades of experience across industries, with particularly deep experience advising clients in the financial services industry, including asset managers, investment advisers, broker‑dealers, banks and private equity firms. We work closely with colleagues across the firm, including in investment management, transactions, employee benefits, tax and regulatory practices, to deliver coordinated and commercially grounded advice. We counsel clients on matters ranging from day-to-day employment and HR-related issues to significant business transactions, including mergers and acquisitions.
We place a strong emphasis on strategic counseling designed to prevent disputes before they arise, or to resolve them quickly and favorably if they do.
When matters cannot be resolved pre-litigation, we regularly litigate in federal and state courts and represent clients before administrative and regulatory agencies, including the Equal Employment Opportunity Commission and state and local human rights agencies. We also appear in arbitrations before the Financial Industry Regulatory Authority, the American Arbitration Association, JAMS and other tribunals.
The disputes we handle are broad. They include claims involving discrimination, harassment and retaliation; breach of contract, wrongful termination and compensation disputes; employee raiding and unfair competition; theft of trade secrets and computer fraud; whistleblower claims under state and federal law; severance claims; and the enforcement or defense of restrictive covenants and related applications for injunctive relief.
