Seward & Kissel team named Litigator of the Week runners-up
Partners Randall Adams and Mark Garibyan and associates Melanie Collins and Benjamin Litvin were selected as “Litigator of the Week” runners-up by The American Lawyer’s Litigation Daily.
They were selected for their victory in the Eleventh Circuit Court of Appeals on behalf of their client Eric Bischoff in a dispute concerning control over shares in Boar’s Head Provisions Inc.
Applying New York law, the Eleventh Circuit ruled that statutes of limitations for contract actions can bare remedies, but cannot create rights that do not otherwise exist under contract. Applying this reasoning, the Eleventh Circuit permitted Mr. Bischoff to proceed with his claim challenging transfers of shares representing approximately 15% of Boar’s Head.
